| RECRUITMENT INDUSTRY
Goodman Derrick LLP offers specialist legal advice to the
recruitment industry.
We have been advisers to the recruitment industry for 20
years. During this time we have acted for the Federation of
Recruitment and Employment Services (FRES) and now the Recruitment
and Employment Confederation (REC).
We also act for a large number of their members, as well
as non-members involved in the industry.
Our unique position has placed us at the forefront of the
industry, and we are familiar with all legal and commercial
issues confronting participants in this field. This means
that we are able to offer unrivalled specialist advice to
employment agencies and recruitment consultancies of all types
and sizes. The areas we cover include:
- Regulatory matters: such as the Employment Agencies Act,
the Conduct of Employment Agencies and Employment Businesses
Regulations, the Money Laundering Regulations, proposed
EU regulation (the Agency Workers Directive).
- Common law obligations of employment agencies: the requisite
standard of service; who is liable if something goes wrong;
the fulfilment of conditions necessary to validly claim
commission.
- Preparation and advice on the terms of business and terms
of engagement for permanent and temporary employment for
all types of client and staff.
- The legal relationship between an employment business
and a temporary worker or contractor and the consequences
flowing from this analysis.
- Non-standard contracts involving competitive tendering,
preferred supply agreements and outsourcing
- Disputes with clients, applicants or third parties over
terms of business
- Immigration issues
- Disputes with employees including the enforcement of
post-termination restrictions.
Advice is often sought in the field of employment law and
the prolific amount of new legislation and continuing developments
both here and in Europe have made the law in this area especially
complex. We are able to offer advice on a full range of contentious
and non-contentious issues relating to employment law and
its particular application to the recruitment industry. For
further details please refer to our Employment Services page.
