Tax, Trusts and Estate Planning

Our Private Client Group is able to offer expert advice to individuals and their families on a wide range of matters.

Whether it is a family matter, preparing tax efficient wills and trusts, administering estates, dealing with lasting powers of attorney or Court of Protection work, we work closely with our clients. We provide a personal and responsive service and take a close interest in our clients’ welfare.

Wills & Estate Planning

When it comes to estate planning, we know that our clients are anxious to preserve as much flexibility as they can while trying to minimise the impact of inheritance and other capital taxes on their assets. We can assist in drafting wills which best suit our clients’ particular family circumstances, such as the protection of the interests of children and grandchildren, in the event of divorce or other claims. If the client wishes, we would also be happy to be appointed as an executor.

We can also advise on how best to make use of lifetime gifts and other transfers so as to reduce the effect of capital gains and inheritance tax liabilities. As regards charitable legacies, we advise clients on the most tax-effective way to make gifts to their chosen charities.

Probate and Administration of Estates

We have wide experience in obtaining probate including dealing with the estates of non-domiciled persons and assets overseas, claiming tax exemptions for heritage property and advising on variations of the Will. We are able to deal with contested applications for probate and challenges to a will.

We can also advise clients on applications to challenge the terms of a will in the event that they have a claim for financial provision from a deceased’s estate.

Trusts

We can establish trusts and settlements both in the UK and offshore. We work closely with our clients’ other professional advisers to achieve our clients’ objectives to mitigate the effect of capital gains tax and inheritance tax.

We can also provide assistance with the day-to–day administration of trusts, including making distributions to beneficiaries, handling requirements in relation to trust accounts and reviewing the strategies chosen for the investment of the trust assets.

Powers of Attorney

Many clients prefer to make their own arrangements as to who should manage their affairs if they are no longer able to do so themselves. We can advise on lasting powers of attorney and if appropriate, act as the attorney, either alone or with other family members.

Court of Protection

We can register enduring and lasting powers of attorney with the Court and have experience in dealing with contested applications to register, applications for statutory Wills and the appointment of deputies.
